Este trabajo analiza la interacción entre el Derecho Internacional de las inversiones y los derechos humanos, considerando estos últimos como la raíz jurídica del concepto de sostenibilidad. Se extraen conclusiones y recomendaciones prácticas, tanto para Estados como para inversores, a fin de reducir las tensiones entre ambos sectores normativos y mejorar el desempeño socioambiental de los proyectos de inversión que desarrollan las empresas transnacionales.
This paper analyses the interaction between International Investment Law and Human Rights, considering the latter as the legal root of the concept of sustainability. It draws conclusions and practical recommendations for both states and investors in order to reduce tensions between the two normative sectors and improve the socio-environmental performance of investment projects developed by transnational corporations.
